ARTICLE 1: GENERAL
Altiservice puts users (hereinafter "User(s)") in contact with Merchants who sell their services via its Marketplace.
These general conditions of use (hereinafter "GCU") govern the relationship between ALTISERVICE and all Users of the Marketplace. The conditions of use of the Marketplace are accessible via the URL https://saint-lary.altiservice.com, (hereinafter "Site").
The Merchants' general terms and conditions of sale (hereinafter "GTCS") apply in addition to the GCU. They may be consulted directly on the site of the Merchant concerned.
When the User orders a ski pass, he/she becomes the Customer (hereinafter "Customer") as defined by article L212-2 II of the French Tourism Code. The User must read and accept, without reservation and without prejudice to the usual means of recourse, these General Terms and Conditions of Use and the General Terms and Conditions of Sale (hereinafter "GTCS") of the Merchants selected. Acceptance is evidenced by ticking the appropriate box.
In the event that the GCU and the merchant's General Terms and Conditions of Sale are contradictory, these GCU shall prevail.
The GCU may be amended at a later date, in which case the version applicable to the User will be that in force on the Website on the date the order is placed.
No provision contrary to these Terms and Conditions may be invoked against Altiservice, unless expressly accepted in advance by Altiservice.
ARTICLE 2: SERVICE OFFER
The Marketplace, accessible via the URL indicated in the previous article, brings together several commercial offers from service providers (hereinafter referred to as "Merchants") located near Saint-Lary in order to offer Users a wide range of choices and thus improve the scope of the services offered.
Among these offers, Users may find, without this list being exhaustive:
- Purchase of packages
- Accommodation
- Equipment hire
- Booking ski lessons
- Activities and purchase of various services
The User can reserve one or more offers. The offers listed on the Marketplace are offers marketed by professional or non-professional Merchants in the field of accommodation. It is the User's responsibility to find out about the products and rates offered and to select the most advantageous for him. Altiservice cannot be held responsible for the User's choice.
ARTICLE 3: RESERVATION AND ONLINE ORDER
3.1 CHOICE
The User selects via the Site: https://saint-lary.altiservice.com, the product(s) marketed by Altiservice and/or the Merchants, that he wishes to order in order to fill his electronic basket, by selecting the date of stay, the commercial offer(s) of his choice.
The registration of the basket requires the identification of the User via various information such as, for example: surname, first name, date of birth and email.
3.2 ORDERING
Before placing an order, the Customer undertakes to check his/her basket and modify it if it does not meet his/her requirements.
Placing an order implies the Customer's knowledge and acceptance of these GCU and, where applicable, of the Merchants' GCS. If this is not the case, the order cannot be processed.
The online ordering procedure is reserved for Users who are at least 18 years old and have the legal capacity to contract.
In the case of a group order, i.e. an order for more than two people, the User must have the consent of all the people for whom the services are reserved by the Site, as well as the authorisation of the parents of all minors taking part.
The User guarantees the accuracy of the information provided.
3.3 PAYMENT
A summary of the offers ordered is displayed, specifying the total amount of the order in euros, including VAT.
The prices of commercial offers are freely set by the Merchants. Prices are expressed in euros and include VAT. They are subject to change and are applicable to the Site User from the time they are put online. The applicable price is that in force on the day the order is placed.
To finalise the order, the User, having accepted these GCU and, where applicable, the Merchants' GCS, may proceed to payment by selecting the method of payment.
The User can find the history of his/her orders in the "My Account" tab.
3.4 PAYMENT METHODS
Confirmation of an order on the Website entails payment thereof, in accordance with the methods specified by the Merchant(s) concerned, online, in particular by bank card (Visa MasterCard, E-carte bleue).
Online payment is made via a payment service provider, an electronic money institution; authorised in France and supervised by the ACPR (Autorité de Contrôle Prudentiel et de Résolution).
Orders placed online are confirmed by e-mail, as indicated in the previous article, once the User's bank has given its consent. Refusal by the User's bank to authorise debiting of his/her bank account will result in cancellation of the order.
As soon as payment authorisation and the order have been received, the User will receive an order confirmation by e-mail from each of the Merchants with whom he/she has booked a service, at the address provided by the User when creating his/her account on the Site. The sale will not be considered final until this order acceptance confirmation has been sent.
Once payment has been made, the order can no longer be modified.
Altiservice may not be held liable for any malfunction of the online payment service.
3.5 RIGHT OF WITHDRAWAL
Pursuant to article L221-28 of the French Consumer Code, the services marketed on the Site are not subject to the right of withdrawal provided for in articles L 221-18 et seq. of the French Consumer Code with regard to distance selling and therefore cannot be reimbursed or cancelled once the purchase has been made.
3.6. CANCELLATION AT THE INITIATIVE OF THE CUSTOMER, THE MERCHANT OR ALTISERVICE
The services ordered on the Site are exclusively subject to the cancellation and modification conditions set out in the specific conditions of service of each of the Merchants available on the site: https://saint-lary.altiservice.com.
3.7 INSURANCE
The purchase of an insurance policy is optional, but will entail the obligation for the Customer to pay the amount at the time of payment of the price. Two types of insurance are offered: cancellation insurance, for all purchases made on the Site, and ski insurance offered solely for the purchase of ski passes. Altiservice cannot be held responsible for the Customer's choice.
ARTICLE 4: LIABILITY
In accordance with article L211-1- of the French Tourism Code, Altiservice is fully responsible for the execution of the services contracted in the context of the present contract.
Altiservice may exonerate itself from all or part of its liability by providing proof that the damage is attributable either to the Customer and the persons travelling with him (hereinafter referred to as the "Traveller"), or to a third party not involved in the provision of the travel services included in the contract, or to unavoidable exceptional circumstances.
Unavoidable exceptional circumstances are any situation beyond the control of Altiservice and the Traveller, the consequences of which could not have been avoided even if all reasonable measures had been taken.
Altiservice and the Merchant are responsible for the proper execution of all travel services included in the contract.
ARTICLE 5: COMPLAINTS
In the event of a complaint, the Customer may contact in writing:
- 1st level: the Merchant, giving his contact details (surname, first name, address and booking reference). Requests are processed within 30 days.
- 2nd level: in the event of dissatisfaction or lack of return within 30 days of the initial request, the Customer may contact Altiservice in writing at the following address: reservation@altiservice.com, specifying his contact details (surname, first name, address, booking references and history of exchanges with the Merchant). Requests are processed within 30 days.
- 3rd level: If the response does not meet the customer's expectations, they may lodge an appeal with the Tourism Mediation officer. To contact the Mediation officer, you must first have had recourse to the first two levels described above (Merchant then Altiservice) and be dissatisfied with the proposed solution. Access to the Mediation officer is free of charge. The Mediation officer is totally independent and impartial, and has been registered by the Commission d'Evaluation et de Contrôle de la Médiation de la Consommation on the list of consumer mediators, and as such has been notified to the European Commission. ARTICLE 6: ASSISTANCE
In the event of difficulties encountered by the Customer, Altiservice will provide appropriate assistance as soon as possible in light of the circumstances.
Altiservice reserves the right to charge the Customer a reasonable price for this assistance if this difficulty is caused intentionally by the Traveller or by his negligence.
ARTICLE 7: PROTECTION OF PERSONAL DATA
Within the scope of its activity, Altiservice and each of the Merchants act as data processors.
Altiservice and the Merchants undertake to comply with Regulation (EU) 2016/679 and Regulation (EU) 2018/1725. Altiservice and the Merchants are individually responsible for the processing of data collected directly by each entity. The terms and conditions relating to the protection of personal data carried out by each Merchant are set out in the Merchants' General Terms and Conditions of Sale, which can be consulted on the Site.
Altiservice carries out processing operations in accordance with the following provisions:
- Purpose of processing: sale of ski lift passes and, where applicable, sending promotional offers to Customers or Users.
- Duration of processing: for as long as is necessary to achieve the purposes, in accordance with the limitation periods in force
- Nature of operations: collection, organisation, storage, consultation, deletion, etc.
- Categories of persons concerned by this processing: Customers
- Categories of personal data likely to be processed by Altiservice: Customer civility, address, connection data of Customers consulting the altiservice.com site.
In general, Altiservice and the Merchants are required to :
- Implement technical and organisational measures to guarantee data security such as: measures to limit access to collected data to authorised personnel, measures to protect data during storage and measures to allow data portability and deletion,
- Respond jointly to requests from data subjects. In particular, they are required to forward any such requests to the Customer without delay. The Customer also has the right to oppose, access, rectify and port his or her data in order to retain control over it. Any request to exercise the aforementioned rights must be sent to Altiservice at the following e-mail address: dpo@altiservice.com and to the selected Merchant.
- To cooperate promptly, in the event of a data breach, with the data controller and to provide it with assistance for the purposes of compliance.
- Not to subcontract data processing operations
- Not to transfer said data to a third country without the consent of the data controller
- To delete, at the end of the contract, the personal data processed on behalf of the data controller and to certify this.
ARTICLE 8: ASSIGNMENT OF THE CONTRACT
The Customer may assign the contract, as long as it has not produced any effect, to any person who fulfils the same conditions as him/her for the holiday.
The assignment may only be made on condition that Altiservice is informed by any means that allows an acknowledgement of receipt to be obtained, no later than seven days before the start of the services.
The Customer and the person to whom the Contract has been assigned are jointly and severally liable for the payment, where applicable, of the balance of the price, as well as any fees, charges or other additional costs incurred as a result of this assignment.
This Article does not apply to :
- ski lift passes, including when a furnished rental is ordered for the same holiday,
- in the event of the Customer renting furnished accommodation without ordering any other service for the same holiday.
ARTICLE 9: REMINDER OF THE CUSTOMER'S RIGHTS
The Customer's rights when ordering several Services including the rental of accommodation for at least one night for the purposes of the same holiday are summarised below
The combination of travel services offered to the Customer by Altiservice is a ski pass within the meaning of Directive (EU) 2015/2302 and Article L. 211-2 II of the French Tourism Code.
The Customer therefore benefits from all the rights granted by the European Union applicable to packages, as transposed into the French Tourism Code. Altiservice will be entirely responsible for the proper execution of the ski pass as a whole.
Altiservice has protection in order to refund the Customer's payments and, if transport is included in the ski pass, to ensure its repatriation in the event that it becomes insolvent.
Essential rights under Directive (EU) 2015/2302 transposed into the French Tourism Code:
Travellers will receive all essential information about the ski pass before concluding the ski pass travel contract.
Both the organiser and the retailer are responsible for the proper execution of all travel services included in the contract.
Travellers are provided with an emergency telephone number or contact details enabling them to reach the organiser or retailer.
Passengers may transfer their ski pass to another person, subject to reasonable notice and, where applicable, the payment of additional charges.
The price of the ski pass may only be increased if specific costs increase (e.g. fuel prices) and if this possibility is explicitly provided for in the contract, and in any case may not be changed less than twenty days before the start of the ski pass. If the price increase exceeds 8% of the ski pass price, the traveller may cancel the contract. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction in the event of a reduction in the corresponding costs.
Passengers may cancel the contract without paying cancellation fees and receive a full refund of payments made if any of the essential elements of the ski pass, other than the price, undergoes a significant change. If, before the start of the ski pass, the professional responsible for the pass cancels it, travellers may obtain a refund and compensation, if applicable.
Travellers may cancel the contract without paying a cancellation fee before the start of the ski pass in the event of exceptional circumstances, for example if there are serious safety problems at the destination that are likely to affect the ski pass.
Travellers may also cancel the contract at any time before the start of the ski pass, subject to payment of an appropriate and justifiable cancellation fee.
If, after the start of the ski pass, important elements of the ski pass cannot be provided as planned, travellers must be offered other appropriate Services at no extra cost. Passengers may cancel the contract without paying a cancellation fee if the Services are not performed in accordance with the contract, the ski pass is significantly disrupted as a result and the organiser fails to remedy the problem.
Travellers are also entitled to a price reduction and/or compensation in the event of non-performance or poor performance of travel services.
The organiser or retailer must provide assistance if the traveller is in difficulty.
If the organiser or retailer becomes insolvent, the amounts paid will be refunded. If the organiser or retailer becomes insolvent after the start of the ski pass and if transport is included in the ski pass, repatriation of travellers is guaranteed. Altiservice has taken out insolvency protection with Groupama, n°4000715258, +33(0)1 70 96 63 40, 3 Place Marcel Paul, 92000 NANTERRE.
Directive (EU) 2015/2302 transposed into French law can be consulted on the website https://www.legifrance.gouv.fr.
In the event that the Customer purchases the rental of a seasonal furnished accommodation without ordering any other Service for the purposes of the same stay, the Customer does not benefit from the ski pass protection provided by the French Tourism Code. However, Altiservice or, where applicable, the Merchant concerned is responsible to the Customer for the proper execution of the Service.
ARTICLE 10: NULLITY
If any of the provisions of these GCU are found to be null and void with regard to a rule of law in force or a judicial decision that has become final, it will then be deemed unwritten, without this resulting in the nullity of these GCU or altering the validity of its other stipulations.
ARTICLE 11: APPLICABLE LAW
The GCU and the operations arising therefrom are governed by and subject to French law. In the event of a dispute, only the French text will be deemed authentic.
ARTICLE 12: DISPUTES
12.1 ACCESS TO THE COURTS
Failing an amicable settlement as provided for in article 5 hereof, the dispute will be brought before the competent courts of Toulouse.
12.2 MANDATORY PRE-CONTRACTUAL INFORMATION
The User acknowledges having been informed, prior to placing the order, in a legible and comprehensible manner, of these GCU and of all the information listed in article L. 111-1 et seq. of the French Consumer Code, in particular:
- The essential characteristics of the service;
- The price of the service and any ancillary costs to be expected;
- The methods of classifying and referencing the commercial offers proposed on the Site;
- The terms of payment;
- If the contract is not to be performed immediately, the date or deadline by which the Merchant undertakes to perform the service;
- Where applicable, information relating to legal guarantees, the functionalities of the digital content and, where applicable, its interoperability, the existence and procedures for implementing guarantees and other contractual conditions;
- Information relating to the identity of the Merchant is communicated before the order is placed. The Merchant's postal and electronic contact details will be provided in the order confirmation;
- The possibility of recourse to a mediator in the event of a dispute.

3.4 PAYMENT METHODS

An option to pay in several instalments may be available in certain cases, subject to the following conditions. Our partner Oney Bank offers a financing solution called 3x 4x Oney, which allows you to pay for purchases from €400 in 3 instalments and from €500 for 4 instalments up to €4,000 with a bank card. This offer is reserved for private individuals (over 18 years of age) residing in France and holding a Visa or MasterCard bank card with a validity date longer than the chosen financing period. Systematic authorisation cards such as Electron, Maestro, Nickel, etc., as well as e-cards, Indigo cards and American Express are not accepted. Payment in 3 or 4 instalments by bank card allows you to pay for your order on our website as follows: a compulsory deposit, debited on the day of confirmation of dispatch of your order; two or three monthly instalments, each corresponding to a third or a quarter of the order, debited 30 and 60 days later for the 3 instalment and 30, 60 and 90 days later for the 4 instalment, which include charges corresponding to 1.67% of the total amount of the order for a 3 instalment and 2.50% for a 4 instalment (up to a maximum of €30 for a 3 instalment and €60 for a 4 instalment).
Orders placed online are confirmed by e-mail, as indicated in the previous article, once the User's bank has given its consent. Refusal by the User's bank to authorise debiting of his/her bank account will result in cancellation of the order.
As soon as payment authorisation and the order have been received, the User will receive an order confirmation by e-mail from each of the Merchants with whom he/she has booked a service, at the address provided by the User when creating his/her account on the Site. The sale will not be considered final until this order acceptance confirmation has been sent.
Once payment has been made, the order can no longer be modified.
Altiservice may not be held liable for any malfunction of the online payment service.
3.5 RIGHT OF WITHDRAWAL
Pursuant to article L221-28 of the French Consumer Code, the services marketed on the Site are not subject to the right of withdrawal provided for in articles L 221-18 et seq. of the French Consumer Code with regard to distance selling and therefore cannot be reimbursed or cancelled once the purchase has been made.

- Respond jointly to requests from data subjects. In particular, they are required to forward any such requests to the Customer without delay. The Customer also has the right to oppose, access, rectify and port his or her data in order to retain control over it. Any request to exercise the aforementioned rights must be sent to Altiservice at the following e-mail address: dpo@altiservice.com and to the selected Merchant.
- To cooperate promptly, in the event of a data breach, with the data controller and to provide it with assistance for the purposes of compliance.
- Not to subcontract data processing operations
- Not to transfer said data to a third country without the consent of the data controller
- To delete, at the end of the contract, the personal data processed on behalf of the data controller and to certify this.
ARTICLE 8: ASSIGNMENT OF THE CONTRACT
The Customer may assign the contract, as long as it has not produced any effect, to any person who fulfils the same conditions as him/her for the holiday.
The assignment may only be made on condition that Altiservice is informed by any means that allows an acknowledgement of receipt to be obtained, no later than seven days before the start of the services.
The Customer and the person to whom the Contract has been assigned are jointly and severally liable for the payment, where applicable, of the balance of the price, as well as any fees, charges or other additional costs incurred as a result of this assignment.
This Article does not apply to :
- ski lift passes, including when a furnished rental is ordered for the same holiday,
- in the event of the Customer renting furnished accommodation without ordering any other service for the same holiday.
ARTICLE 9: REMINDER OF THE CUSTOMER'S RIGHTS
The Customer's rights when ordering several Services including the rental of accommodation for at least one night for the purposes of the same holiday are summarised below
The combination of travel services offered to the Customer by Altiservice is a ski pass within the meaning of Directive (EU) 2015/2302 and Article L. 211-2 II of the French Tourism Code.
The Customer therefore benefits from all the rights granted by the European Union applicable to packages, as transposed into the French Tourism Code. Altiservice will be entirely responsible for the proper execution of the ski pass as a whole.
Altiservice has protection in order to refund the Customer's payments and, if transport is included in the ski pass, to ensure its repatriation in the event that it becomes insolvent.
Essential rights under Directive (EU) 2015/2302 transposed into the French Tourism Code:
Travellers will receive all essential information about the ski pass before concluding the ski pass travel contract.
Both the organiser and the retailer are responsible for the proper execution of all travel services included in the contract.
Travellers are provided with an emergency telephone number or contact details enabling them to reach the organiser or retailer.
Passengers may transfer their ski pass to another person, subject to reasonable notice and, where applicable, the payment of additional charges.
The price of the ski pass may only be increased if specific costs increase (e.g. fuel prices) and if this possibility is explicitly provided for in the contract, and in any case may not be changed less than twenty days before the start of the ski pass. If the price increase exceeds 8% of the ski pass price, the traveller may cancel the contract. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction in the event of a reduction in the corresponding costs.
Passengers may cancel the contract without paying cancellation fees and receive a full refund of payments made if any of the essential elements of the ski pass, other than the price, undergoes a significant change. If, before the start of the ski pass, the professional responsible for the pass cancels it, travellers may obtain a refund and compensation, if applicable.
Travellers may cancel the contract without paying a cancellation fee before the start of the ski pass in the event of exceptional circumstances, for example if there are serious safety problems at the destination that are likely to affect the ski pass.
Travellers may also cancel the contract at any time before the start of the ski pass, subject to payment of an appropriate and justifiable cancellation fee.
If, after the start of the ski pass, important elements of the ski pass cannot be provided as planned, travellers must be offered other appropriate Services at no extra cost. Passengers may cancel the contract without paying a cancellation fee if the Services are not performed in accordance with the contract, the ski pass is significantly disrupted as a result and the organiser fails to remedy the problem.
Travellers are also entitled to a price reduction and/or compensation in the event of non-performance or poor performance of travel services.
The organiser or retailer must provide assistance if the traveller is in difficulty.
If the organiser or retailer becomes insolvent, the amounts paid will be refunded. If the organiser or retailer becomes insolvent after the start of the ski pass and if transport is included in the ski pass, repatriation of travellers is guaranteed. Directive (EU) 2015/2302 transposed into French law can be consulted on the website https://www.legifrance.gouv.fr.
In the event that the Customer purchases the rental of a seasonal furnished accommodation without ordering any other Service for the purposes of the same stay, the Customer does not benefit from the ski pass protection provided by the French Tourism Code. However, Altiservice or, where applicable, the Merchant concerned is responsible to the Customer for the proper execution of the Service.
ARTICLE 10: NULLITY
If any of the provisions of these GCU are found to be null and void with regard to a rule of law in force or a judicial decision that has become final, it will then be deemed unwritten, without this resulting in the nullity of these GCU or altering the validity of its other stipulations.
ARTICLE 11: APPLICABLE LAW
The GCU and the operations arising therefrom are governed by and subject to French law. In the event of a dispute, only the French text will be deemed authentic.
ARTICLE 12: DISPUTES
12.1 ACCESS TO THE COURTS
Failing an amicable settlement as provided for in article 5 hereof, the dispute will be brought before the competent courts of Toulouse.
12.2 MANDATORY PRE-CONTRACTUAL INFORMATION
The User acknowledges having been informed, prior to placing the order, in a legible and comprehensible manner, of these GCU and of all the information listed in article L. 111-1 et seq. of the French Consumer Code, in particular:
- The essential characteristics of the service;
- The price of the service and any ancillary costs to be expected;
- The methods of classifying and referencing the commercial offers proposed on the Site;
- The terms of payment;
- If the contract is not to be performed immediately, the date or deadline by which the Merchant undertakes to perform the service;
- Where applicable, information relating to legal guarantees, the functionalities of the digital content and, where applicable, its interoperability, the existence and procedures for implementing guarantees and other contractual conditions;
- Information relating to the identity of the Merchant is communicated before the order is placed. The Merchant's postal and electronic contact details will be provided in the order confirmation;
- The possibility of recourse to a mediator in the event of a dispute.
